Shared Decision-Making is a widely accepted model of the physician–patient relationship providing an ethical environment in which physician beneficence and patient autonomy are respected. It acknowledges the moral responsibility of physician and patient by promoting a deliberative collaboration in which their individual expertise—complementary in nature, equal in importance—is emphasized, and personal values and preferences respected. Its goal coincides with Pellegrino and Thomasma’s proximate end of medicine, that is, a technically correct and morally good healing decision for and with a particular (...) patient. We argue that by perfecting the intellectual ability to apprehend the complexity of clinical situations, and through a perfection of the application of the first principles of practical reason, prudence is able to point toward the right and good shared medical decision. A prudent shared medical decision is therefore always in keeping with the kind of person the physician and the patient have chosen to be. (shrink)

Clinical ethics refers to an emerging field in clinical medicine that focuses on the process of ethical decision-making in a clinicalsetting. It has developed as a result of a growing awareness that modern medicine – characterized by technological progress, culturaldiversity and social challenges – is posing a range of new “ethical dilemmas” that medical science alone cannot solve. For thisreason, clinical ethics is often linked to “ethics consultation,” which consists of services provided by an individual ethicist, ethicsteam or committee to (...) address the ethical issues involved in a specific clinical case. Although clinical ethics developed in the beginningmainly as a methodological analysis to arrive at a justification for clinical ethical decisions, it quickly has become clear thatthe difficulty in clinical decision-making is only one aspect of wider ethical problems pertaining to the doctor-patient relationshipas a whole and, most likely, to the core value of the medical profession. The principles method is usually presented as the mostpopular methodological approach to an analysis of clinical cases. However, strong criticism of this model has been voiced, and otheralternative approaches are referred to, such as the casuistry model. Recently, significant contributions have been made by narrativemedicine and virtue ethics. According to these methodologies, sound anthropology and a good relationship with the sick person arekey elements required of any person engaged in medical practice who aims to be genuinely appropriate from an ethical perspective. Resumen: Las nuevas tecnologías biomédicas han planteado la posibilidad de intervenir en la capacidad de decisión sobre el bien y el mal, es decir, en la evaluación de la moralidad de los actos humanos. Aunque estas intervenciones (genéticas o neurológicas) no pretenden alterar la identidad del individuo, sus planteamientos no lo descartan. En consecuencia, el dilema entre terapia y mejora, en el contexto moral, adquiere especial relevancia. Aunque la terapia intentaría restaurar la capacidad individual para decidir entre el bien y (...) el mal, la mejora biomédica plantea otros objetivos para los que es necesario abordar los fundamentos de la entidad humana, en particular algunos conceptos filosóficos como la identidad y la autonomía. Desde la filosofía moral, el desarrollo del individuo debe estructurarse fuera del campo tecnológico y abordar una perspectiva que considere el factor relacional y la existencia del otro como elemento fundamental para alcanzar la plenitud del ser humano. Abstract: The new biomedical technologies have raised the possibility of intervening in the decision-making capacity regarding good and evil, that is, in the evaluation of the morality of human acts. Although these interventions (genetic or neurological) do not intend to alter the identity of the individual, their approaches do not rule it out. Consequently, the dilemma between therapy and improvement, in the moral context, acquires special relevance. Although the therapy would try to restore the individual capacity to decide between good and evil, biomedical enhancement raises other objectives for which it is necessary to address the foundations of the human entity, in particular some philosophical concepts such as identity and autonomy. From moral philosophy, the development of the individual must be structured outside the technological field and approach a perspective that considers the relational factor and the existence of the other as a fundamental element to achieve the fullness of the human being. The use of sedation at the end of life is proving a difficult topic of bioethical debate. In spite of efforts to reach agreement on definitions and guidelines, the practice most commonly known as palliative, or terminal, sedation remains a source of ambiguity and confusion. The goal of this article is to offer the reader a primer on the topic of palliative sedation. The moral debate on living-donor organ transplantation historically focused on how to overcome the problem of the mutilation inherent in such a medical operation. In time, theologians began proposing justifications of LDOT that assumed that “mere removals” did not constitute mutilation. The example of mutilation as an “intrinsically evil act” in Veritatis splendor would seem to have closed the debate. Nevertheless, many theologians continue to address LDOT as a question of justifying a mutilation. This text proposes an interpretation of the work of Franklin Leopoldo e Silva based on the reading of some of his numerous published articles and books, without neglecting the classes and guidance received from the stage of Scientific Initiation to Postdoctoral studies. Precisely, by highlighting the importance of three thinkers widely studied by Professor Franklin – Berkeley, Bergson and William James –, we suggest that at the heart of this philosophical experience there would be a constant: empiricism. If for Henry, Life is absoluteimmanence, for Augustine it is also extasis. If for the first desire has to be reduced to mere immanence,for the later this desire (appetitus) is one of the ways in which man can encounter the Absolute.

La idealización del diálogo es un gesto característico no sólo del pensamiento filosófico contemporáneo, sino también de las ciencias humanas y de los procedimientos de intervención pedagógica, terapéutica y organizacional. En este artículo revisaremos críticamente ese mito fundacional del diálogo socrático, mediante un análisis conversacional de los movimientos y las funciones discursivas que en él se desarrollan. Además, exploraremos la evolución moderna del género del diálogo filosófico.

En este trabajo intentaré mostrar que, de acuerdo con Agustín de Hipona –y a diferencia de una cierta lectura relativamente clásica de Pascal–, el deseo puede ser el comienzo de la relación del hombre con el Absoluto. Para ello divido el texto en cuatro partes: primero, describo la situación existencial primordial de la que nace el deseo, la inquietud. Después, describo el doble despliegue del deseo: amor o concupiscencia, según objeto e inclinación. This work focuses on the role that music has in the constitution of the World as a philosophical category. I explore the work of Eugenio Trías and Augustine of Hippo, and the way both philosophers have conceptualized music in relation to the constitution of the time of the World. For Trías music is not about the World but about its limits and, in that way, gives it a form. Michel Janssen and Harvey Brown have driven a prominent recent debate concerning the direction of an alleged arrow of explanation between Minkowski spacetime and Lorentz invariance of dynamical laws in special relativity. In this article, I critically assess this controversy with the aim of clarifying the explanatory foundations of the theory. First, I show that two assumptions shared by the parties—that the dispute is independent of issues concerning spacetime ontology, and that there is an urgent need for a constructive interpretation (...) of special relativity—are problematic and negatively affect the debate. Second, I argue that the whole discussion relies on a misleading conception of the link between Minkowski spacetime structure and Lorentz invari-ance, a misconception that in turn sheds more shadows than light on our understand-ing of the explanatory nature and power of Einstein’s theory. I state that the arrow connecting Lorentz invariance and Minkowski spacetime is not explanatory and uni-directional, but analytic and bidirectional, and that this analytic arrow grounds the chronogeometric explanations of physical phenomena that special relativity offers. When we speak about different interpretations of quantum mechanics it is suggested that there is one single quantum theory that can be interpreted in different ways. However, after an explicit characterization of what it is to interpret quantum mechanics, the right diagnosis is that we have a case of predictively equivalent rival theories. I extract some lessons regarding the resulting underdetermination of theory choice. Issues about theoretical identity, theoretical and methodological pluralism, and the prospects for a realist stance towards quantum (...) theory can be properly addressed once we recognize that interpretations of quantum mechanics are rival theories. According to a popular narrative, in 1932 von Neumann introduced a theorem that intended to be a proof of the impossibility of hidden variables in quantum mechanics. However, the narrative goes, Bell later spotted a flaw that allegedly shows its irrelevance. Bell’s widely accepted criticism has been challenged by Bub and Dieks: they claim that the proof shows that viable hidden variables theories cannot be theories in Hilbert space. Bub’s and Dieks’ reassessment has been in turn challenged by Mermin and (...) Schack. Hereby I critically assess their reply, with the aim of bringing further clarification concerning the meaning, scope and relevance of von Neumann’s theorem. I show that despite Mermin and Schack’s response, Bub’s and Dieks’ reassessment is quite correct, and that this reading gets strongly reinforced when we carefully consider the connection between von Neumann’s proof and Gleason’s theorem. To what degree can language be acquired from linguistic input alone? This question has vexed scholars for millennia and is still a major focus of debate in the cognitive science of language. The complexity of human language has hampered progress because studies of language–especially those involving computational modeling–have only been able to deal with small fragments of our linguistic skills. We suggest that the most recent generation of Large Language Models (LLMs) might finally provide the computational tools to determine empirically (...) how much of the human language ability can be acquired from linguistic experience. LLMs are sophisticated deep learning architectures trained on vast amounts of natural language data, enabling them to perform an impressive range of linguistic tasks. We argue that, despite their clear semantic and pragmatic limitations, LLMs have already demonstrated that human-like grammatical language can be acquired without the need for a built-in grammar. Thus, while there is still much to learn about how humans acquire and use language, LLMs provide full-fledged computational models for cognitive scientists to empirically evaluate just how far statistical learning might take us in explaining the full complexity of human language. We say that a sentence A is a permissive consequence of a set X of premises whenever, if all the premises of X hold up to some standard, then A holds to some weaker standard. In this paper, we focus on a three-valued version of this notion, which we call strict-to-tolerant consequence, and discuss its fruitfulness toward a unified treatment of the paradoxes of vagueness and self-referential truth. For vagueness, st-consequence supports the principle of tolerance; for truth, it supports the (...) requisite of transparency. Permissive consequence is non-transitive, however, but this feature is argued to be an essential component to the understanding of paradoxical reasoning in cases involving vagueness or self-reference. In 1991 Larry Laudan and Jarret Leplin proposed a solution for the problem of empirical equivalence and the empirical underdetermination that is often thought to result from it. In this paper we argue that, even though Laudan and Leplin’s reasoning is essentially correct, their solution should be accurately assessed in order to appreciate its nature and scope. Indeed, Laudan and Leplin’s analysis does not succeed in completely removing the problem or, as they put it, in refuting the thesis of underdetermination (...) as a consequence of empirical equivalence. Instead, what they show is merely that science possesses tools that may eventually lead out of an underdetermination impasse. We apply their argument to a real case of two empirically equivalent theories: Lorentz’s ether theory and Einstein’s special relativity. This example illustrates the validity of Laudan and Leplin’s reasoning, but also shows the importance of the reassessment we argue for. (shrink)

It is a widespread belief that the Kochen-Specker theorem imposes a contextuality constraint on the ontology of beables in quantum hidden variables theories. On the other hand, after Bell’s influential critique, the importance of von Neumann’s wrongly called ‘impossibility proof’ has been severely questioned. However, Max Jammer, Jeffrey Bub and Dennis Dieks have proposed insightful reassessments of von Neumann’s theorem: what it really shows is that hidden variables theories cannot represent their beables by means of Hermitian operators in Hilbert space. Hereby I show that i) the very same constraint can be derived from Gleason’s theorem, and that ii) if we consider the import of von Neumann’s and Gleason’s theorems, the relevance of the Kochen-Specker theorem for hidden variables theories gets substantially weakened: it does not force them to be contextual in any interesting sense of the term. In this paper I argue that the case of Einstein׳s special relativity vs. Hendrik Lorentz׳s ether theory can be decided in terms of empirical evidence, in spite of the predictive equivalence between the theories. In the historical and philosophical literature this case has been typically addressed focusing on non-empirical features. I claim that non-empirical features are not enough to provide a fully objective and uniquely determined choice in instances of empirical equivalence. However, I argue that if we consider arguments proposed (...) by Richard Boyd, and by Larry Laudan and Jarret Leplin, a choice based on non-entailed empirical evidence favoring Einstein׳s theory can be made. Human dignity: social movements invoke it, several national constitutions enshrine it, and it features prominently in international human rights documents. But what is it, why is it important, and what is its relationship to human rights and social justice? Pablo Gilabert offers a systematic defence of the view that human dignity is the moral heart of justice. In Human Dignity and Human Rights (OUP 2019), he advanced an account of human dignity for the context of human rights discourse, which (...) covers the most urgent, basic claims of dignity. This book extends the dignitarian approach to more ambitious claims of maximal dignity of the kind encoded in democratic socialist conceptions of social justice. In particular, this book focuses on the just organization of working practices. It recasts in a dignitarian format the critique of capitalist society as involving exploitation, alienation, and domination of workers, and revamps a neglected but inspiring socialist principle. In its dignitarian interpretation, the Abilities/Needs Principle (‘From each according to their ability, to each according to their needs!’) yields reasonable and feasible requirements on social cooperation geared to empowering each human being to lead a flourishing life. While Human Dignity and Human Rights offered the first systematic philosophical account of human dignity in human rights discourse, Human Dignity and Social Justice presents the first systematic application of the dignitarian framework to the core ideals of democratic socialism. As English Studies researchers and teachers, our experience has shown that there continues to exist an urgent need to incorporate gender as a reading tool of literary texts to foster a non-discriminatory and equality perspective. Given the many advances in gender equality that have been achieved as well as the rising backlash against such progressive moves that spread through Europe, our proposal is based on the “queerification of the classroom”, a notion defined as a transgressive initiative that effectively and systematically (...) incorporates the deconstruction of normativity and fosters resistance to socially constructed assumptions about normativity and deviance. In this paper we investigate a semantics for first-order logic originally proposed by R. van Rooij to account for the idea that vague predicates are tolerant, that is, for the principle that if x is P, then y should be P whenever y is similar enough to x. The semantics, which makes use of indifference relations to model similarity, rests on the interaction of three notions of truth: the classical notion, and two dual notions simultaneously defined in terms of it, (...) which we call tolerant truth and strict truth. We characterize the space of consequence relations definable in terms of those and discuss the kind of solution this gives to the sorites paradox. We discuss some applications of the framework to the pragmatics and psycholinguistics of vague predicates, in particular regarding judgments about borderline cases. (shrink)

Objetivo. Verificar si el procesamiento semántico de estímulos visuales complejos, como la repetición, la identidad, el orden y la doble incongruencia, es recursivo o computable. Sujetos y métodos. Veintisiete universitarios respondieron a un paradigma adaptado N400 con cinco condiciones, cada una con 80 tareas, mientras se registraba su actividad cerebral con un gorro de 64 electrodos. Resultados. Dos ventanas temporales de 400 a 550 ms y de 550 a 800 ms se analizaron mediante un contraste ANOVA del factor condición por (...) regiones de interés. Además, se calculó la solución inversa de las ventanas mediante tomografía electromagnética de baja resolución para identificar las fuentes corticales subyacentes a los potenciales eléctricos. Se corroboran diferencias significativas (p< 0, 05) en los potenciales N400 y P600 en áreas frontales y centroparietales asociadas a los operadores lógicos estudiados. Conclusión. Se confirma que el procesamiento cerebral de imágenes complejas (congruentes/incongruentes) es modulado por la repetición, la identidad y el orden, pero no por la negación. Por consiguiente, se puede decir que el procesamiento semántico de imágenes complejas es semicomputable. (shrink)

One way in which we might approach the challenge posed by the Sorites Paradox is considering that Sorites-susceptible predicates have several candidate extensions, or several ways in which these expressions can be made precise. For example, a candidate extension for the predicate ‘is a baby’ is the set of humans of less than two years, but also the set of those less than two years and one second, and of those less than two years and two seconds. In this chapter (...) we present and discuss two theories for vague predicates based on this idea: supervaluationism and subvaluationism. The chapter is structured in three parts. The first presents the super- and subvaluationist theories: their similarities and differences in the semantics, the resulting logics with their most characteristic features. The second reviews the super- and subvaluationist solutions to the Sorites Paradox and provides discussion on several controversies surrounding these theories. In this article, we review the Agrarian Question focusing on dairy farms. We have the dual aim of adding to the debate surrounding the economic profitability of small and large dairy farms and increasing what is known about the decline of dairy farms. The agrarian question at the heart of our research centres on the paradoxical endurance of family farms, despite predictions from both liberal and Marxist perspectives that they would diminish in number over time. By addressing these complex issues, (...) we hope to shed light on the challenges and opportunities facing the dairy industry today. We focus on analysing dairy farms in the European Union countries, using panel regressions from 2008 to 2018 to define the relationship between the average number of cows per farm, profit margins and Farm Net Income. The most important results show that (i) paradoxically, profits were higher on smaller farms; (ii) however, empirical data show that small dairy farms are disappearing; (iii) this is because when including subsidies, farms with a higher number of cows are more profitable than smaller farms. It is common in political theory and practice to challenge normatively ambitious proposals by saying that their fulfillment is not feasible. But there has been insufficient conceptual exploration of what feasibility is, and very little substantive inquiry into why and how it matters for thinking about social justice. This paper provides one of the first systematic treatments of these issues, and proposes a dynamic approach to the relation between justice and feasibility that illuminates the importance of political imagination and dynamic (...) duties to expand agents’ power to fulfill ambitious principles of justice. This paper presents and defends a way to add a transparent truth predicate to classical logic, such that and A are everywhere intersubstitutable, where all T-biconditionals hold, and where truth can be made compositional. A key feature of our framework, called STTT (for Strict-Tolerant Transparent Truth), is that it supports a non-transitive relation of consequence. At the same time, it can be seen that the only failures of transitivity STTT allows for arise in paradoxical cases.

Resumen Las enfermedades raras o poco frecuentes constituyen un tema muy complejo desde el punto de vista socio-sanitario y también desde el punto de vista comunicativo. Afectan a menos de 5 por 10.000 personas y suelen ser graves y crónicas. La mayor parte son de origen genético por lo que, con frecuencia, se manifiestan en la etapa infantil. Apenas un diez por ciento tiene tratamientos efectivos. Son pocos los estudios que han abordado el discurso sobre estas patologías. Las ER constituyen (...) aún un tópico que podríamos denominar ‘emergente’ para los profesionales de los medios de comunicación. En este artículo vamos a analizar la representación de las enfermedades raras y de sus principales protagonistas en un corpus de 436 piezas informativas correspondientes a enero de 2014. Do we have positive duties to help others in need or are our moral duties only negative, focused on not harming them? Are any of the former positive duties, duties of justice that respond to enforceable rights? Is their scope global? Should we aim for global equality besides the eradication of severe global poverty? Is a humanist approach to egalitarian distribution based on rights that all human beings as such have defensible, or must egalitarian distribution be seen in an associativist (...) way, as tracking existing frameworks such as statehood and economic interdependence? Are the eradication of global poverty and the achievement of global equality practically feasible or are they hopelessly utopian wishes? -/- This book argues that there are basic positive duties of justice to help eradicate severe global poverty; that global egalitarian principles are also reasonable even if they cannot be fully realized in the short term; and that there are dynamic duties to enhance the feasibility of the transition from global poverty to global equality in the face of nonideal circumstances such as the absence of robust international institutions and the lack of a strong ethos of cosmopolitan solidarity. The very notion of feasibility is crucial for normative reasoning, but has received little explicit philosophical discussion. This book offers a systematic exploration of that concept as well as of its application to global justice. It also arbitrates the current debate between humanist and associativist accounts of the scope of distributive justice. Drawing on moral contractualism (the view that we ought to follow the principles that no one could reasonably reject), this book provides a novel defense of humanism, challenges several versions of associativism (which remains the most popular view among political philosophers), and seeks to integrate the insights underlying both views. The purpose of this paper is to analyze the virtue of temperance as a moral competence in professional performance. The analysis relies on three different streams of literature: virtue ethics, positive psychology and competency-based management. The paper analyzes how temperance is defined in each of these perspectives. The paper proposes an integrative definition of temperance as “moral competence” and summarizes behaviors in business environments in which temperance plays a role.

In this paper, I develop a quasi-transcendental argument to justify Kant’s infamous claim “man is evil by nature.” The cornerstone of my reconstruction lies in drawing a systematic distinction between the seemingly identical concepts of “evil disposition” (böseGesinnung) and “propensity to evil” (Hang zumBösen). The former, I argue, Kant reserves to describe the fundamental moral outlook of a single individual; the latter, the moral orientation of the whole species. Moreover, the appellative “evil” ranges over two different types of moral failure: (...) while an “evil disposition” is a failure to realize the good (i.e., to adopt the motive of duty as limiting condition for all one’s desires), an “evil propensity” is a failure to realize the highest good (i.e., to engage in the collective project of transforming the legal order into an ethical community). This correlation between units of moral analysis and types of obligation suggests a way to offer a deduction of the universal propensity on behalf of Kant. It consists in tracing the source of radical evil to the same subjective necessity that gives rise to the doctrine of the highest good. For, at the basis of Kant’s two doctrines lies the same natural dialectic between happiness and morality. While the highest good brings about the critically acceptable resolution of this dialectic, the propensity to evil perpetuates and aggravates it. Instead of connecting happiness and morality in an objective relation, the human will subordinatesmorality to the pursuit of happiness according to the subjective order of association. If this reading is correct, it would explain why prior attempts at a transcendental deduction have failed: interpreters have looked for the key to the deduction in the body of Kant’s text, where it is not to be found, for it is tucked, instead, in the Preface to the first edition. This paper is concerned with the claim that supervaluationist consequence is not classical for a language including an operator for definiteness. Although there is some sense in which this claim is uncontroversial, there is a sense in which the claim must be qualified. In particular I defend Keefe's position according to which supervaluationism is classical except when the inference from phi to Dphi is involved. The paper provides a precise content to this claim showing that we might provide complete (and (...) sound) systems of deduction for supervaluationist consequence in which proofs are completely classical with the exception of a single last step (involving the above mentioned inference). A considerable number of books and papers have analyzed normative concepts using new techniques developed by logicians; however, few have bridged the gap between the English legal culture and the Continental tradition in legal philosophy. This book addresses this issue by offering an introductory study on the many possibilities that logical analysis offers the study of legal systems. The volume is divided into two sections: the first covers the basic aspects of classical and deontic logic and its connections, advancing an (...) explanation of the most important topics of the discipline by comparing different systems of deontic logic and exploring some of the most important paradoxes in its domain. The second section deals with the role of logic in the analysis of legal systems by discussing in what sense deontic logic and the logic of norm-propositions are useful tools for a proper understanding of the systematic structure of law. Substructural approaches to paradoxes have attracted much attention from the philosophical community in the last decade. In this paper we focus on two substructural logics, named ST and TS, along with two structural cousins, LP and K3. It is well known that LP and K3 are duals in the sense that an inference is valid in one logic just in case the contrapositive is valid in the other logic. As a consequence of this duality, theories based on either logic are (...) tightly connected since many of the arguments for and objections against one theory reappear in the other theory in dual form. The target of the paper is making explicit in exactly what way, if any, ST and TS are dual to one another. The connection will allow us to gain a more fine-grained understanding of these logics and of the theories based on them. In particular, we will obtain new insights on two questions concerning ST which are being intensively discussed in the current literature: whether ST preserves classical logic and whether it is LP in sheep’s clothing. Explaining in what way ST and TS are duals requires comparing these logics at a metainferential level. We provide to this end a uniform proof theory to decide on valid metainferences for each of the four logics. This proof procedure allows us to show in a very simple way how different properties of inferences (unsatisfiability, supersatisfiability and antivalidity) that behave in very different ways for each logic can be captured in terms of the validity of a metainference.
